Overview of Digital Evidence
Using chats, call records, emails and devices as proof in court. Messages, recordings or call details are central to the case. Electronic records are admitted with a certificate under the Bharatiya Sakshya Adhiniyam, 2023 (earlier the Evidence Act).
The Bharatiya Sakshya Adhiniyam, 2023, which replaced the Indian Evidence Act, 1872 from 1 July 2024, treats electronic records as documents and requires a certificate for copies. The certificate is mandatory when the original device is not produced, so it should be prepared when the evidence is collected.
Scope. Covers preserving chats, calls and emails, certification of electronic records, and forensic examination of devices.
Procedure: how a Digital Evidence case usually moves
- Preserve the original device; do not delete or edit data
- Back up data and capture dated screenshots
- Obtain the certificate for electronic records
- Prove the record through witnesses and, where needed, forensic examination
Important points to keep in mind
- Never alter or delete the original message or device.
- Metadata such as dates and phone numbers helps prove authenticity.
- The person who produced the record may need to be examined about it.
Practical guidance on Digital Evidence
Collect digital evidence carefully and early. Export chats in full rather than selecting parts, note the device model and number used, and keep the original handset unaltered. Evidence collected incompletely can weaken a case rather than strengthen it.
Documents required for Digital Evidence
- Original phone or device
- chat exports
- call detail records
- email headers
- forensic report if available
Digital Evidence for clients living outside India
Evidence located abroad, such as emails, cloud backups and overseas bank records, needs careful preservation and proper certification. Orders passed in India can be enforced against assets in India, while enforcement abroad depends on the law of the country concerned.
